Terms & Conditions
By using Smoothping you agree to be bound by these terms, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. These terms take effect immediately upon your first visit. If you do not agree to all of the following terms, please do not access Smoothping. If any of these terms or conditions are not met, your account is subject to closure.
Security
Smoothping takes security very seriously. We strongly advise all members to NOT use the same username and password that they use for their game account to register for Smoothping's service. Your information is safe with us and we will not share any of your personal details with anyone else.
Liability
In no event shall Smoothping, its suppliers or related software developers be liable for any damages (including, without limitation, damages for loss of data or profit, loss of game account) arising out of the use or inability to use the materials on Smoothping's Internet site, even if Smoothping has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Usage
Use of Smoothpings servers are limited to gameplay. You may not use them for:
- Any malicious activities
- Downloading files
- As a proxy (e.g. web browsing, IRC)
You shall not give out your account details to anyone.
Usage of Smoothping requires either our Smoothping Elite software client OR Putty and Freecap (or alternative Proxy software) - two popular free (and safe) software programs created by a 3rd party developers. We do not ask you to install any non-safe programs.
Communication
Very rarely, Smoothping may send out promotional e-mails or newsletters about major upcoming changes. Upon confirmation of your Smoothping account, your e-mail address is added to our mailing list. You may opt out of these e-mails by selecting the opt-out link on the member profile page or by contacting Smoothping Support and requesting that your e-address be removed from our list.
General
If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.
The failure or delay of Smoothping to exercise or enforce any right in these terms does not waive Smoothping's right to enforce that right.
External Links
Smoothping has not reviewed all of the sites linked from the smoothping.com website and is not responsible for the contents of any such site. There is a members forum which is moderated; however, inappropriate external links may be posted by members and exist until removed by a Smoothping moderator. The inclusion of any link does not imply endorsement by Smoothping. Use of any such linked web site is at the user's own risk.
Terms and Conditions Modifications
Smoothping may revise these terms and conditions for its web site at any time without notice.
